CONSENT CALENDAR
All matters listed under the Consent Calendar are considered by the Council to be routine and will be enacted by one motion without discussion. If discussion is desired, that item may be removed and considered separately.

City Council Meeting Minutes — Approval

Approve the special and regular minutes of the City Council meetings of November 18, 2024, and the regular minutes of the City Council meeting on December 9, 2024.

CEQA: This minutes approval is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)

City Council 2025 Regular Meeting Calendar — Adoption

Approve an amendment to the City Council Regular Meeting schedule for the calendar year 2025.

CEQA: This administrative action is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)

5.

Fund Reservation Agreement for Fleet Electric Vehicle Charging Infrastructure — Approval

Approve three Fund Reservation Agreements with Peninsula Clean Energy for the City to receive up to $270,000 to offset the expense of the installation of electric vehicle chargers at three City facilities for fleet charging.

CEQA: Entering into a fund reservation agreement is not a project subject to CEQA, because it is a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. (CEQA Guidelines Section 15378(b)(4).)

6.

Construction Special Inspection Services for the Clean Water Program — Amendment

Approve Amendment No. 5 to the professional services agreement with Signet Testing Laboratories, Inc. for as-needed construction special inspection services for various Clean Water Program projects to increase the agreement by $150,000, for a total revised agreement amount of $2,700,000; and authorize the Public Works Director to execute the amendment in substantially the form presented and issue project-specific task orders under the agreement.

CEQA: The City prepared a Final Programmatic Environmental Impact Report (Final PEIR) in accordance with the California Environmental Quality Act (CEQA) (SCH No. 2015032006). The PEIR was certified by Council on June 6, 2016. In accordance with CEQA, the Final PEIR serves as the primary environmental compliance document for implementation of the Clean Water Program. The City prepared Addenda to the Final PEIR that were approved on July 16, 2018 (Addendum 1) and April 15, 2019 (Addendum 2). This work is within the scope of the project evaluated in the PEIR and Addendum

7.

Sale of Water-Filled Barriers — Authorization

Authorize the City Manager to execute a sales contract allowing for the sale of 310 used water-filled barriers by the City to Marina Landscape, Inc. for a total price of $38,750.

CEQA: This Council action is exempt from CEQA review under the “common sense” exemption because it can be seen with certainty that there is no possibility that the sale of 310 used water-filled barriers may have a significant effect on the environment. CEQA Guidelines Section 15061(b)(3).)

8.

Basin C Sanitary Sewer Rehabilitation Project  — Agreement

Award an agreement to Westland Contractors, Inc. for the Basin C Sanitary Sewer Rehabilitation Project in an amount not to exceed $5,953,822; establish a contingency in the amount of $900,000; and authorize the Public Works Director to execute the agreement in substantially the form presented and issue change orders within the contingency amount.

CEQA: The work addressed by this administrative report is being undertaken to support the Clean Water Program. This project is subject to the requirements of the California Environmental Quality Act (CEQA), the general components of which are included as part of the Final Programmatic Environmental Impact Report (Final PEIR) (SCH No. 201532006) that was prepared for the Clean Water Program. The Final PEIR was certified by City Council on June 6, 2016. The City prepared Addenda to the Final PEIR that was approved on July 16, 2018 (Addendum 1) and April 15, 2019 (Addendum 2). This work is within the scope of the Project evaluated in the PEIR and Addendum.

9.

Police Department and Parks and Recreation — Classification Updates

Adopt a Resolution to approve the job specification revisions and a salary range increase for the Police Digital Forensic Specialist based on a classification analysis and to approve the revised job specifications for the Landscape Laborer and Landscape Maintenance Worker I/II to reflect a flexible staffed series pursuant to the recent MOU agreement.

CEQA: This classification update is not a project subject to CEQA, because it is a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment.(CEQA Guidelines Section 15378(b)(4).)

​​San Mateo Adult and Career Education Recreation Instruction Services — Agreement ​

Approve an agreement with San Mateo Union High School District for Recreation Services facilitated by San Mateo Adult and Career Education in an amount not to exceed $25,000, for a term from January 6, 2025, through June 30, 2026, and authorize the Parks and Recreation Director to execute the agreement in substantially the form presented.

CEQA: This agreement is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)

PUBLIC COMMENT
Members of the public wishing to comment on any item not appearing on the agenda may address the City Council at this time. State law prevents Council from taking action on any matter not on the agenda; your comments may be referred to staff for follow up. Public comment is limited to a total of 15 minutes; however, an opportunity for additional public comment may be provided later in the agenda.
 

OLD BUSINESS

11.

Third Avenue and South Norfolk Street Intersection Modification Project — Appropriation, Budget Transfers, and Agreement

Adopt a Resolution authorizing an appropriation of $200,000 from the City’s Measure A funds, and budget transfers of $65,000 from the Traffic Signal Video Detection Replacement Project and $40,000 from the Bike San Mateo Program Project to the Community Development Block Grant Projects project budget in the Capital Project Fund; approve an agreement with Liffey Electric, Inc. for construction of the 3rd Avenue and South Norfolk Street Intersection Modification Project in the amount of $1,298,745; establish a contingency reserve in the amount of $200,000; and authorize the Public Works Director to execute the agreement in substantially the form presented and issue change orders as allowed by the contract documents and within the contingency amount.

CEQA: This Project is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. (CEQA Guidelines Section 15301.)

PUBLIC HEARING
City Council action on the following public hearing(s) represents a final decision concluding all administrative proceedings. Judicial review may be had only if a petition is filed with the Court not later than the 90th day following the date the decision is made. Judicial review of environmental determinations may be subject to a time period for litigation as short as 30 days following the date the decision is made.
 
12.

Solid Waste 2025 Rate Setting and Proposition 218 Notification —Approval

Provide direction on proposed increases to residential and commercial solid waste rates and commercial organics collection rates and authorize staff to mail a Proposition 218 Notification to all property taxpayers proposing a not-to-exceed increase in solid waste, recycling, and compost collection rates for 2025.

CEQA: ​​This action by the City in setting the maximum rates to be charged by Recology San Mateo County relates to funding an on-going solid waste collection service and is not a project subject to CEQA, because it is a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. (CEQA Guidelines Section 15378(b)(4).)​

13.

New Construction Reach Codes for the 2022 Code Cycle — Ordinance Introduction

Introduce an Ordinance to amend the San Mateo Municipal Code Chapter 23.24 "Energy Code" and Chapter 23.70 "Green Building Code" to require enhanced energy performance for new construction, repeal unenforceable measures of the City's current reach codes, and make a minor edit to the City's electric-readiness requirements.

CEQA: In accordance with CEQA Guidelines Section 15308, this action to adopt reach codes and amend the Energy Code and Green Building Code is categorically exempt from CEQA as an action by a regulatory agency for the protection of the environment, because reach codes are intended to reduce greenhouse gas emissions.

City Council Appointments to External Agencies and Liaison Roles — Approval

Review and provide direction on the 2025 appointments to external agencies, organizations, and liaison roles; consider and approve the final appointments and liaisons list.
