CONSENT CALENDAR
All matters listed under the Consent Calendar are considered by the Council to be routine and will be enacted by one motion without discussion. If discussion is desired, that item may be removed and considered separately.
 
3.

City Council Meeting Minutes – Approval

Approve the minutes of the City Council Special and Regular meeting of March 15, 2021.

4.

Sustainability and Infrastructure Commission – Appointment Subcommittee Recommendation

Approve the recommendation of the the Sustainability and Infrastructure Commission appointment subcommittee to appoint Kimiko Narita to the unexpired term through June 10, 2023 vacated by Jackie Nunez.

5.

Ordinance Introduction – Amend Municipal Code Chapter "Placing Certain Objects in the Public Right of Way"

Introduce an Ordinance to amend the San Mateo Municipal Code Chapter 17.08.020 "Placing Certain Objects in the Public Right of Way" to allow for public markers and making other necessary minor revisions to the chapter.

 

6.

Workers' Compensation Program Third Party Administration – Contract

Approve Amendment No. 1 to the contract with LWP Claims Solutions for the purpose of the City's self-insured workers' compensation program for an additional two-year term in the amount of $530,613 for a new contract total of $748,367.

7.

California Transportation Commission Local Streets and Roads – Project List

Adopt a Resolution to submit a list of projects proposed to be funded with the Road Repair and Rehabilitation Account, Senate Bill 1 funding, to the California Transportation Commission for fiscal year 2021-22.

8.

Transit-Oriented Development Pedestrian Access Plan – Agreement

Approve a professional services agreement with Fehr & Peers for the Transit-Oriented Development Pedestrian Access Plan in the amount of $133,000; establish a contingency reserve of $10,000; and authorize the acting Public Works Director to execute the agreement in substantially the form presented and approve amendments within the contingency reserve.

25th Avenue Grade Separation Project – License Agreements

Approve a license agreement with Peninsula Joint Powers Board and San Mateo County Transportation Agency to allow public access on 28th Avenue from El Camino Real to S. Delaware Street and authorize the City Manager to execute the agreement in substantially the form presented.

10.

Public Works Capital Improvement Projects – Appropriation Adjustments

Adopt a Resolution to adjust appropriations for certain Public Works-related Capital Improvement Program projects.

11.

2020-21 Sanitary Sewer Root Foaming (North Basin) – Agreement

Award an agreement to Duke’s Root Control, Inc. for the 2020-21 Sanitary Sewer Root Foaming project in an amount not to exceed $251,726.28; establish a contingency reserve of $25,000; and authorize the Acting Public Works Director to execute the agreement in substantially the form presented and issue change orders within the contingency reserve.

Downtown Opportunity Sites Environmental Remediation – Agreement

Approve entering into a Standard Voluntary Cleanup Agreement with the Department of Toxic Substances Control for their administrative oversight of hazardous materials remediation on the Downtown Opportunity Sites and authorize the City Manager to execute the agreement in substantially the form presented and make adjustments to the scope as needed during the course of the work.

13.

385 2nd Ave – Lease Agreement

Approve a one-year lease and one-year option at 385 2nd Avenue in the Main Street Garage with Dagoberto Vasquez and Anavela Vasquez for a term beginning 4/1/2021 and an initial base rent of $1,206.30 monthly and authorize the City Manager to execute the lease in substantially the form presented.

14.

Independent Audit Services – Agreement

Approve an agreement with The Pun Group LLP for independent audit services for an amount not to exceed $67,000.00 fiscal year (FY) 2020-21, $68,340.00 for FY 2021-22, $69,706.80 for FY 2022-23, $71,100.93 for FY 2023-24, and $72,522.95 for FY 2024-25 and authorize the Finance Director to execute the agreement in substantially the form presented.

City Council Strategic Plan – Adoption

Adopt the City Council Strategic Plan for fiscal year 2021-22.

Ordinance Adoption – Accessory Dwelling Unit and Junior Accessory Dwelling Unit Updates

Adopt an Ordinance to amend San Mateo Municipal Code Chapter 27.19 – “Accessory Dwelling Unit and Junior Accessory Dwelling Unit – Residential Zones” in accordance with changes to State law and “Junior Accessory Dwelling Unit” definition, as amended to allow detached accessory dwelling units to be built up to a maximum of 16 feet to top-of-plate and up to 24 feet overall to the highest point of the roof, as measured from existing grade.

PUBLIC COMMENT
Members of the public wishing to comment on any item not appearing on the agenda may address the City Council at this time. State law prevents Council from taking action on any matter not on the agenda; your comments may be referred to staff for follow up. Public comment is limited to a total of 15 minutes; however, an opportunity for additional public comment may be provided later in the agenda.
 
PUBLIC HEARING
City Council action on the following public hearing(s) represents a final decision concluding all administrative proceedings. Judicial review may be had only if a petition is filed with the Court not later than the 90th day following the date the decision is made. Judicial review of environmental determinations may be subject to a time period for litigation as short as 30 days following the date the decision is made.
 
17.

Unpaid Sidewalk Repair Charges for Service – Proposed Property Tax Liens

Adopt a Resolution to approve the list of properties with unpaid sidewalk repair costs, and direct staff to forward the list to the County Controller’s Office for collection of these unpaid sidewalk repair costs on the property tax rolls.

COVID-19 Update

Receive update on operational impacts and other City efforts related to COVID-19 and confirm rules and regulations issued by the City Manager acting as the Director of Emergency Services in response to declared emergency.

NEW BUSINESS

19.

Proposed Fireworks Amendments – Ordinance Introduction

Receive a presentation on illegal fireworks activity and enforcement efforts; provide feedback on the use of acoustic detection technology as a tool to identify locations where illegal fireworks are being used; and introduce an Ordinance to add Chapter 10.20 “Fireworks” to the San Mateo Municipal Code related to enforcement of fireworks violations.

20.

City Attorney – Appointment

Adopt a Resolution to appoint Prasanna Rasiah as City Attorney, establishing his initial compensation, and authorize the Mayor to execute the employment agreement.

21.

Interim City Attorney – Appointment 

Adopt a Resolution to approve the appointment of Gabrielle Whelan as the Interim City Attorney.
