PUBLIC COMMENT
During the public comment period, members of the public may speak on general items of interest within the Commission's jurisdiction that are not on the agenda.  Each member of the public may speak for a maximum of three minutes with a maximum of 15 minutes for the entire public comment period. The Chair shall determine whether the matter is within the Commission's jurisdiction. The Commission shall not act on or discuss any matters raised during the public comment period, which are not on the agenda, but shall refer such matters to staff for review and/or request such matters be placed on a future agenda.

PUBLIC HEARING
Planning Commission decisions are final unless appealed to the City Council in accordance with Section 27.08.090 and Section 27.08.060 of the San Mateo Municipal Code. The time within which judicial review of any final decision may be sought is governed by Code of Civil Procedure section 1094.6. If any person challenges a Planning action in court, they may be limited to raising only those issues raised at the public hearing or in written correspondence delivered to the City of San Mateo, at or prior to, the public hearing. Some public hearings will be automatically referred to City Council and those will be indicated below.

29 Baytree Way and 22 De Sabla Road Duplex Condominium Conversion – Tentative Parcel Map and Parking Variance (PA-2022-064)

Adopt a resolution to approve a Tentative Parcel Map, Variance (Parking and Setbacks), Site Plan and Architectural Review, and California Environmental Quality Act (CEQA) exemption for the conversion of an existing duplex from single entity ownership into a condominium which would allow each unit to be individually owned based on the Findings for Approval and subject to the Conditions of Approval in Attachment 1.


CEQA: This project is categorically exempt from environmental review, pursuant to the California Environmental Quality Act (CEQA) Guidelines, Class 1 Section 15301(k) Division of Existing Multiple Family or Single-Family Residences into Common-Interest Ownership because the project represents a conversion of an existing duplex from single entity ownership into common ownership condominium units.

Bay Meadows Phase II Development Agreement – Annual Review and Extension Request (PA-2023-050)

Adopt a Resolution accepting the Annual Reports on the Bay Meadows Phase II Development Agreement finding that Bay Meadows Main Track Investors, LLC has complied in good faith with the terms of the Development Agreement for the period covering December 21, 2020 through December 20, 2022; and Recommend to City Council adoption of an Ordinance to approve a three-year extension of the Bay Meadows Phase II Development Agreement.

CEQA: In accordance with California Environmental Quality Act (CEQA) Guidelines section 15378(b)(5), the Development Agreement annual review is not a project subject to CEQA because it is an administrative action that will not impact the physical environment.

In addition, the City Council certified the Final Environmental Impact report (EIR) for the San Mateo Rail Transit-Oriented Development Corridor Plan and the Bay Meadows Phase II Specific Plan Amendment, in compliance with the California Environmental Quality Act (CEQA) on April 18, 2005. The City Council then approved the Bay Meadows Specific Plan Amendment, re-certified the Final EIR for that project, and adopted the findings and statement of overriding considerations on November 7, 2005. Because there are no substantial changes to the project and no new information has become available since the time of the EIR, no further CEQA analysis is required at this time (CEQA Section 21166).
