City Council Meeting Minutes - Approval

Approve the minutes of the special and regular meetings of March 6, 2023.

City Council Appointments to External Agencies and Liaison Roles - Amendment

Approve the amended Council Appointments list for 2023 with new appointments.

Termination of Proclamation of a Local Emergency

Adopt a Resolution terminating the declaration of a local emergency.

6.

San Mateo Building Decarbonization Strategy – Appropriation and Agreement

Adopt a Resolution to appropriate $115,600 of committed fund balance from the Advance Planning Fund to the Sustainability Program within the City Manager’s Office for the development of a building decarbonization strategy; approve an agreement with Rincon Consultants, Inc. for the development of a building decarbonization strategy in the amount of $115,600; and authorize the City Manager to execute the agreement in substantially the form presented.

CEQA: This agreement is not a project subject to CEQA, because it can be seen with certainty that it will not cause a physical change in the environment. (Public Resources Code Section 21065.)

7.

Downtown Electric Vehicle Chargers – Appropriation

Adopt a Resolution to authorize a budget transfer of $28,000 from unassigned fund balance from the General Fund to the Capital Improvement Project for the installation of electric vehicle chargers at the 2nd and El Camino Garage.

CEQA: This funding appropriation is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)

8.

Housing Element Update Consulting Services – Amendment

Approve Amendment No. 2 to the agreement with Diana R. Elrod Consulting Services for Housing Element Update Services to extend the term of the agreement from March 30, 2023 to December 31, 2023, with no change to the agreement total, and authorize the Community Development Director to execute the amendment in substantially the form presented.

CEQA: This agreement is not a project subject to CEQA, because it can be seen with certainty that it will not cause a physical change in the environment. (Public Resources Code Section 21065.)

​General Plan, Housing Element, and Housing Successor Agency – 2022 Annual Progress Reports

​​Accept the Annual Progress Reports for General Plan, Housing Element, and Housing Successor Agency, and direct the Community Development Director to file the reports with the State of California. ​

CEQA: This Annual Progress Reports on the General Plan, Housing Element and Housing Successor Agency are not a project subject to CEQA, because they are an organizational or administrative activity that will not result in direct or indirect physical changes in the environment (CEQA Guidelines Section 15378(b)(5)).

10.

Library Department – Classification and Position Updates

Adopt a Resolution to approve: the elimination of one (1) vacant Librarian I Per Diem and one (1) vacant Literacy Specialist Per Diem; the addition of one (1) Librarian I/II merit Full-Time Equivalent (FTE) in the Children's/Literacy Division; the elimination of three (3) vacant Library Assistant I Per Diem positions; and the addition of one (1) Library Assistant I/II merit FTE in the Circulation/Technical Services Division.

CEQA: This classification update is not a project subject to CEQA, because it can be seen with certainty that it will not cause a physical change in the environment. (Public Resources Code Section 21065.)

San Mateo Public Library Foundation Operating Lease – Amendment

Approve an amendment to the property lease and operating agreement with the San Mateo Public Library Foundation to extend the lease for an additional year commencing on April 1, 2023 through March 31, 2024; and authorize the City Librarian to execute the amendment in substantially the form presented.

CEQA: This lease is not a project subject to CEQA, because it is a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. (CEQA Guidelines Section 15378(b)(4).)

12.

Axon Air Unmanned Aerial Systems Program – Amendment

Approve Amendment No. 2 to the master services and purchasing agreement with Axon Enterprise, Inc., to provide an unmanned aerial systems program for a five-year term in the amount of $110,575.95, for a new cumulative agreement total of $1,676,003.63; and authorize the Chief of Police to execute the amendment in substantially the form presented.

CEQA: This action is not a project subject to CEQA, because it can be seen with certainty that it will not cause a physical change in the environment. (Public Resources Code Section 21065.)

13.

Police Department Roof Improvements – Budget Appropriation and Agreement

Adopt a Resolution to appropriate $150,000 of unassigned fund balance from the General Fund to the Police Department Roof Improvements project; approve an agreement with McGinnis Chen Associates, Inc. for professional roof design services in an amount not to exceed $92,500 with a contingency of $13,875; and authorize the Public Works Director to execute the agreement in substantially the form presented and issue amendments within the contingency amount. 

CEQA: This Project is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. (CEQA Guidelines Section 15301.)

14.

Construction Special Inspection Services for the Clean Water Program – Amendment

Approve Amendment No. 1 for professional services with Signet Testing Laboratories, Inc. to provide as-needed construction special inspection services for various Clean Water Program projects; increase the agreement amount by $400,000 for a revised total of $1,900,000; and authorize the Public Works Director to execute the amendment in substantially the form presented and issue project-specific task orders under the agreement.

CEQA: The City prepared a Final Programmatic Environmental Impact Report (Final PEIR) in accordance with the California Environmental Quality Act (CEQA) (SCH No. 2015032006). The PEIR was certified by Council on June 6, 2016. The Final PEIR serves as the primary environmental compliance document for implementation of the Clean Water Program. The City approved Addenda to the Final PEIR on July 16, 2018 (Addendum 1) and April 15, 2019 (Addendum 2). This work is within the scope of the project evaluated in the PEIR and Addendum.

15.

Purchase of Replacement Digester Sludge Transfer Pumps – Change Order

Approve Contract Change Order No. 1 to the contract with Shape Inc. for the purchase of replacement digester sludge transfer pumps in an amount not to exceed $8,992.16 for a total contract amount of $105,717.16; and authorize the Public Works Director to execute the contract change order in substantially the form presented.

CEQA: This Council action is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use. (CEQA Guidelines Section 15301.)

16.

School Zone Speed Limit Phase 1 – Agreement

Approve an agreement with JJ Construction and Design Inc. for the School Zone Speed Limit Phase 1 project in the amount of $164,975; establish a contingency reserve in the amount of $16,500; and authorize the Public Works Director to execute the agreement in substantially the form presented and issue change orders within the amount of the contingency amount.

CEQA: This project is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use. (CEQA Guidelines Section 15301.)

Martin Luther King Community Center Small Kitchen Remodel – Contract

Adopt a Resolution to approve an alternative purchasing procedure to award a construction contract to Newton Construction & Management, Inc. to remodel the small kitchen at the Martin Luther King Community Center in the amount of $149,127.11; establish a contingency reserve in the amount of $25,000; and authorize the Public Works Director to execute the contract in substantially the form presented and issue change orders within the contingency amount.

CEQA:This project is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. (CEQA Guidelines Section 15301.)

PUBLIC COMMENT
Members of the public wishing to comment on any item not appearing on the agenda may address the City Council at this time. State law prevents Council from taking action on any matter not on the agenda; your comments may be referred to staff for follow up. Public comment is limited to a total of 15 minutes; however, an opportunity for additional public comment may be provided later in the agenda.
 
PUBLIC HEARING
City Council action on the following public hearing(s) represents a final decision concluding all administrative proceedings. Judicial review may be had only if a petition is filed with the Court not later than the 90th day following the date the decision is made. Judicial review of environmental determinations may be subject to a time period for litigation as short as 30 days following the date the decision is made.

Fiscal Year 2022-23 Comprehensive Fee Schedule – Amendment for Planning Support Fee

Adopt a Resolution to approve amendments to the Planning Support Fee for Building Permits.

Review and comment on the proposed work plan and resource requirements for the draft City Council fiscal year 2023-24 priority list.

20.

Pedestrian Mall Design – Contract Amendment

Adopt a Resolution to approve a supplemental budget appropriation of $130,766 from the unassigned fund balance of the General Fund to the Pedestrian Mall Design project to cover the cost of the first and second amendments to the agreement with Community Design + Architecture and the contingency reserve; approve the second amendment to the agreement with Community Design + Architecture to increase the contract amount to a total not to exceed $262,251 for additional design work and engineering support services; establish a contingency reserve of $14,000; and authorize the City Manager to execute the agreement in substantially the form presented and approve amendments within the contingency amount.

22.

​Complete Streets Plan - Introduction and Community Engagement​

Receive an introduction and overview of the San Mateo Complete Streets Plan and provide feedback on the draft community engagement plan.

CEQA: This project introduction and review of the draft community engagement plan is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).) An environmental analysis of the final Complete Streets Plan will be completed prior to adoption.
