City Council Meeting Minutes - Approval

Approve the minutes of the City Council special and regular meetings of November 7, 2022.

CEQA: This approval is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)

San Mateo Consolidated Fire Department Board – Appointment

Appoint Councilmember Lee as the alternate to the San Mateo Consolidated Fire Department Board of Directors.

CEQA: This administrative action is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)

5.

Police Activities League – Reorganization and Appropriation

Adopt a Resolution to reorganize the structure of the Police Activities League and authorize the appropriation of funds in the amount of $95,688 from the Police Activities League to reallocate a vacant Community Services Supervisor to a Community Services Section Manager and to add one additional Full Time Equivalent (FTE) Community Services Coordinator position.

CEQA: This resolution is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)

6.

Downtown Business Improvement Area - Ordinance Adoption

Adopt an Ordinance to modify the basis and method of levy for the Downtown Business Improvement Area (DBIA).

CEQA: This item is exempt from California Environmental Quality Act (CEQA) requirements because it is an administrative activity that will not have a significant effect on the environment per CEQA Guidelines section 15378(b)(5).

7.

San Mateo Public Library Main Branch Café Operating Lease – Agreement

Adopt a Resolution to approve a Property Lease and Operating Agreement with Rafat Haddad for operation of the 3 Bees Café at the Main Library Branch for two years commencing on November 22, 2022 through November 21, 2024 in accordance with Municipal Code Section 3.62.030(b); and authorize its execution by the City Librarian.

CEQA: This amendment is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)

8.

Downtown San Mateo Grade Separation Consolidated Railroad Infrastructure and Safety Improvements Program – Application

Adopt a Resolution to authorize an application for the Federal Railroad Administration Railroad (CRISI) Program in the amount of $6,000,000 to fund the development of a project study report, preliminary engineering plans, and environmental planning documents to assess the Reconnecting San Mateo Grade Separations Project; commit $2,000,000 in local matching funds; and authorize the City Manager, to execute a funding agreement with the Federal Railroad Administration.

CEQA: The authorization of a grant application is not a project subject to CEQA because it is a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment, and because a grant application is an administrative activity that will not result in direct or indirect physical changes to the environment. (CEQA Guidelines Sections 15378(b)(4), (b)(5))

Marina Lagoon Vegetation and Water Quality Management – Appropriation and Amendment

Adopt a Resolution to appropriate $316,300 to the Marina Lagoon Management budget from the City’s General Fund; approve Amendment No. 5 to the agreement with Waterworks Industries, Inc. to add scope, extend the term until March 15, 2024, and add compensation for Marina Lagoon vegetation and water quality management in the amount of $830,000 for a new agreement total of $1,738,980; establish a contingency reserve of $82,000; and authorize the Public Works Director to execute the amendment in substantially the form presented and issue any change orders within the contingency amount.

CEQA: This Vegetation and Water Quality Management Agreement is categorically exempt from CEQA because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use. (CEQA Guidelines Section 15301.)

Gasoline Fuel Procurement and Delivery Services – Amendment

Approve Amendment No. 3 to the agreement with Pinnacle Petroleum, Inc. for gasoline fuel procurement and delivery services in the amount of $250,000, for a new overall potential agreement total of $1,625,000, inclusive of the City’s remaining options to extend the agreement; establish a contingency reserve in the amount of $100,000; and authorize the Public Works Director to execute the agreement in substantially the form presented and issue any change orders within the contingency amount.

CEQA: This amendment is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)

11.

Renewable Diesel Fuel Procurement and Delivery Services – Amendment

Approve Amendment No. 3 to the agreement with Bosco Oil, Inc. dba Valley Oil Company for procurement and delivery of red and clear renewable diesel services in the amount of $150,000, for a new overall potential agreement total of $975,000, inclusive of the City’s remaining options to extend the agreement; establish a contingency reserve in the amount of $60,000; and authorize the Public Works Director to execute the amendment in substantially the form presented and issue any change orders as allowed by the agreement within the contingency amount.

CEQA: This amendment is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)

12.

Transfer of Property Rights from County of San Mateo to City of San Mateo – Amendment

Adopt a Resolution to approve the amendment to the agreement for transfer of property rights from the County of San Mateo to the City of San Mateo with regard to the North Shoreview Flood Improvement project and authorize the City Manager to execute the amendment in substantially the form presented.

CEQA: This amendment is not subject to CEQA, because it is an administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).) CEQA analysis was completed for the North Shoreview Flood Improvements Project and was approved by City Council on October 19, 2015. Under section 15074 of the CEQA Guidelines, the City adopted a negative declaration for this project.

PUBLIC COMMENT
Members of the public wishing to comment on any item not appearing on the agenda may address the City Council at this time. State law prevents Council from taking action on any matter not on the agenda; your comments may be referred to staff for follow up. Public comment is limited to a total of 15 minutes; however, an opportunity for additional public comment may be provided later in the agenda.
 
PUBLIC HEARING
City Council action on the following public hearing(s) represents a final decision concluding all administrative proceedings. Judicial review may be had only if a petition is filed with the Court not later than the 90th day following the date the decision is made. Judicial review of environmental determinations may be subject to a time period for litigation as short as 30 days following the date the decision is made.

2023 Solid Waste Collection Rates – Increase

Adopt a Resolution to establish maximum rates for solid waste, recycling, and organic collection for Rate Year 2023.

CEQA: This action by the City in setting the maximum rates to be charged by Recology San Mateo County relates to funding an on-going solid waste collection service and is a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. (CEQA Guidelines Section 15378(b)(4).)

OLD BUSINESS

14.

Transit-Oriented Development Pedestrian Access Plan – Adoption

Adopt a Resolution to adopt the City of San Mateo Transit-Oriented Development Pedestrian Access Plan.

CEQA: The Transit-Oriented Development Pedestrian Access Plan is statutorily exempt from CEQA under Public Resources Code Sections 21080.20 and 21080.25 because all the proposed projects in the Plan are consistent with CEQA-exempt transportation projects as provided by SB 288. Individual projects in the Plan are not yet funded, and each project will require a separate CEQA analysis at the time of design and construction. Additionally, the Plan is not a project subject to CEQA because it can be seen with certainty that adoption of the Plan itself will not cause physical change in the environment. (Public Resources Code Section 21065.)
